Article 258
National Inclusion Commission
: (1) There shall be a National Inclusion Commission in Nepal consisting of a Chairman and up to four other members.
(2) The President shall appoint the chairman and members of the National Inclusion Commission on the recommendation of the Constitutional Council.
(3) The term of office of the chairman and members of the National Inclusion Commission will be six years from the date of appointment.
(4) Notwithstanding anything contained in sub-section (3), the post of the chairman or member of the National Inclusion Commission shall be deemed to be vacant in any of the following cases:-
(a) If he tenders his resignation in writing to the President,
(b) If he attains the age of sixty-five years,
(c) If the resolution of impeachment is passed against him in accordance with Article 101,
(d) If the President dismisses a person who is in service due to physical or mental illness and is unable to perform his/her duties due to physical or mental illness, if the President dismisses him/her on the recommendation of the Constitutional Council. (e) In case of his death.
(5) Chairman and members appointed according to sub-section (2) cannot be re-appointed. However, a member can be appointed to the post of chairman and if such a member is appointed to the post of chairman, the period of membership will also be counted as a pair when calculating his term of office.
(6) A person having the following qualifications shall be eligible to be appointed to the post of Chairman or Member of the National Inclusion Commission:-
(a) At least ten years of social inclusion, people with disabilities, minority and marginalized communities and backward areas and classes have made significant contributions in the field of rights or development or human rights,
(b) In the case of the Chairman, having obtained a graduation degree from a recognized university,
(c) having completed the age of forty-five years,
(d) not being a member of any political party at the time of appointment, and
(e) Having high moral character.
(7) The remuneration and service conditions of the chairman and members of the National Inclusion Commission shall be in accordance with the federal law and the remuneration and service conditions shall not be changed to the detriment of him as long as he remains in office. (8) A person who has been the chairman or a member of the National Inclusion Commission shall not be eligible for appointment to other government services.
